A recent decision by the 9th Circuit Court protects thousands of low-income people in affordable rental housing in rural areas in California and the Northwest. The ruling ensures that these affordable rental homes subsidized by the federal government do not lose their affordability before the mortgages come due. The National Housing Law Project, a MacArthur grantee, filed an amicus brief in support of the government's position that owners of these properties cannot avoid affordability restrictions by paying off the subsidized loans early. The owner in the case paid off a loan before it came due in order to end its obligations to provide rents affordable to low-income people. The court decision furthers a precedent established in an earlier case filed by the Law Project.
